Please read these Terms of Service ("Terms") carefully before using the Herb Dock Platform. These Terms constitute a legally binding agreement between you and Herb Dock LLC ("Herb Dock," "we," "us," or "our"). By accessing or using the Platform in any way, you agree to be bound by these Terms.

Important: These Terms contain a binding arbitration clause and class action waiver in Section 16. Please read Section 16 carefully as it affects your legal rights.

1. Definitions

"Platform" means herbdock.com, scan.herbdock.com, and any associated applications or services operated by Herb Dock.

"Scanning App" means the eye scanning and iridology-based supplement recommendation application available at scan.herbdock.com.

"Products" means the herbal supplement products available for purchase through the Platform.

"User," "you," or "your" means any individual who accesses or uses the Platform, including customers, visitors, and affiliate partners.

"Content" means all text, images, data, software, and other materials available on or through the Platform.

"Scan Data" means the eye scan images and resulting supplement recommendations generated through use of the Scanning App.

2. Acceptance of Terms

By creating an account, making a purchase, using the Scanning App, or otherwise accessing the Platform, you confirm that:

You are at least 18 years of age
You have the legal capacity to enter into a binding agreement
You have read, understood, and agree to be bound by these Terms and our Privacy Policy
If you are using the Platform on behalf of a business or organization, you have authority to bind that entity to these Terms

If you do not agree to these Terms, you must immediately stop using the Platform. We reserve the right to modify these Terms at any time. We will notify you of material changes via email or prominent notice on the Platform. Your continued use after the effective date of any changes constitutes acceptance of the updated Terms.

3. Eligibility and Account Registration

3.1 Age Requirement

The Platform is intended for users who are 18 years of age or older. By using the Platform, you represent and warrant that you meet this age requirement. We do not knowingly permit users under 18 to create accounts or make purchases. If we become aware that a user is under 18, we will terminate their account immediately.

3.2 Account Creation

To make purchases or use the Scanning App, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activity that occurs under your account
Notify us immediately of any unauthorized use of your account at support@herbdock.com

We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, including for violation of these Terms.

4. The Scanning App and Iridology Service

4.1 Nature of the Service

Important Disclaimer: The Scanning App uses iridology-inspired artificial intelligence ("AI") analysis to suggest herbal supplement combinations. Iridology is an alternative wellness practice and is not recognized as a medical diagnostic method by conventional medicine. The recommendations generated by the Scanning App are for general wellness informational purposes only and do not constitute medical advice, diagnosis, or treatment.

By using the Scanning App, you acknowledge and agree that:

Supplement recommendations are generated by automated AI analysis and are not reviewed by licensed medical professionals. AI-generated results are subject to mistakes.
Results are intended as a starting point for personal wellness exploration, not as a substitute for professional medical advice.
You should consult a qualified healthcare provider before starting any new supplement regimen, particularly if you are pregnant, nursing, taking medications, or have an existing health condition.
Herb Dock makes no representations or warranties that any supplement will diagnose, treat, cure, or prevent any disease or health condition.
Individual results will vary and are not guaranteed.

4.2 Acceptable Use of the Scanning App

When using the Scanning App, you agree to:

Submit only images of your own eye, taken voluntarily and with your informed consent
Not submit images of other individuals without their explicit written consent
Not attempt to reverse engineer, decompile, or extract the underlying AI models or algorithms
Not submit false, manipulated, or synthetic images in an attempt to game or deceive the recommendation system
Not use automated scripts, bots, or other tools to submit scans in bulk or at scale
Not attempt to probe, test, or exploit vulnerabilities in the Scanning App
Not use the Scanning App for any commercial purpose other than your personal supplement purchasing

4.3 Scan Data and Consent

By submitting an eye scan, you grant Herb Dock a limited license to process your scan image for the purpose of generating supplement recommendations. You further consent to Herb Dock retaining a de-identified copy of your scan image (unlinked from your personal information) for the purpose of training and improving our AI models, as described in our Privacy Policy.

You may withdraw your consent to AI training data use at any time by contacting privacy@herbdock.com. Withdrawal of consent for AI training does not affect the processing already performed to generate your recommendations.

4.4 Availability

We do not guarantee that the Scanning App will be available at all times. We may suspend, modify, or discontinue the Scanning App or any of its features at any time without notice. Herb Dock is not liable for any loss or inconvenience resulting from unavailability of the Scanning App.

5. Products and Purchases

5.1 Product Descriptions

We make every effort to accurately describe our Products, including ingredients, suggested use, and wellness positioning. However, we do not warrant that product descriptions are complete, accurate, or error-free. Product images are for illustrative purposes only and the actual product may vary.

5.2 Pricing and Payment

All prices are listed in US Dollars (USD) unless otherwise stated
Prices are subject to change at any time without notice, but changes will not affect orders already placed
You agree to pay all charges at the prices in effect at the time of your order
Payment is processed through Shopify Payments and associated payment processors. By providing payment information, you authorize us to charge your payment method for the total amount of your order including any applicable taxes and shipping
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or pricing errors

5.3 Sales Tax

Applicable sales tax will be calculated and added to your order total at checkout based on your shipping address and applicable state and local tax laws. You are responsible for any taxes, duties, or customs charges applicable to your order.

5.4 Shipping

Herb Dock ships from the United States to addresses within the USA and select international destinations. Shipping times and costs are calculated at checkout and are estimates only — we are not responsible for carrier delays. Risk of loss and title for products pass to you upon delivery to the carrier.

5.5 Subscriptions

Herb Dock does not currently offer subscription or auto-refill services. If we introduce subscription offerings in the future, we will update these Terms accordingly and provide you with clear notice of subscription terms, billing frequency, and cancellation rights before you enroll.

6. Returns and Refunds

We stand behind our products and want you to be completely satisfied with your Herb Dock purchase.

6.1 Refund Policy and Returns

We offer refunds on purchases according to our Refund Policy, which may be found on our website along with these Terms of Service and other policies. Returns are also covered by the Refund Policy.

7. Intellectual Property

7.1 Our Content

All content on the Platform, including but not limited to text, graphics, logos, product images, AI models, recommendation algorithms, software, and the Herb Dock brand, is owned by or licensed to Herb Dock and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any Platform content without our express written permission.

7.2 Limited License to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial purposes. This license does not include the right to scrape, download in bulk, or systematically collect any content from the Platform.

7.3 Your Content

By submitting reviews, feedback, or other content to the Platform, you grant Herb Dock a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and display that content in connection with operating and promoting the Platform. You represent that you own or have the rights to any content you submit and that it does not violate any third party's rights.

7.4 Feedback

If you provide us with suggestions, ideas, or feedback about the Platform or our products, you agree that we may use this feedback without any obligation to compensate you or keep it confidential.

8. Prohibited Conduct

You agree not to use the Platform to:

Violate any applicable law, regulation, or third-party rights
Engage in fraudulent, deceptive, or misleading activity
Transmit viruses, malware, or any other harmful code
Attempt to gain unauthorized access to any part of the Platform or its infrastructure
Interfere with or disrupt the Platform or servers connected to it
Collect personal information about other users without their consent
Use the Platform to send unsolicited commercial messages (spam)
Impersonate any person or entity or misrepresent your affiliation
Post or transmit content that is defamatory, obscene, harassing, or otherwise objectionable
Violate the acceptable use provisions of the Scanning App set out in Section 4.2

We reserve the right to investigate and take appropriate action against any violation of this section, including suspending or terminating your account and reporting conduct to law enforcement authorities.

9. Third-Party Services and Links

The Platform integrates with and may link to third-party services including Shopify, Klaviyo, GoAffPro, Judge.me, SendGrid, and others. These third-party services are governed by their own terms of service and privacy policies. Herb Dock is not responsible for the practices or content of any third-party services. Your use of third-party services is at your own risk.

Links to external websites are provided for convenience only and do not constitute endorsement of those sites or their content.

10. Health and Safety

Herbal supplements may interact with prescription medications, over-the-counter drugs, or other supplements. Some products may not be appropriate for individuals with certain medical conditions. Before using any Herb Dock product, you should:

Consult your physician or a qualified healthcare provider, particularly if you are pregnant, breastfeeding, have a chronic medical condition, or take prescription medications
Read all product labels and ingredient lists carefully
Discontinue use and seek medical attention if you experience any adverse reaction

Herb Dock products are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration (FDA).

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

HERB DOCK DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; (B) DEFECTS WILL BE CORRECTED; (C) THE PLATFORM OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE PLATFORM, INCLUDING SUPPLEMENT RECOMMENDATIONS, WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HERB DOCK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

Your access to or use of (or inability to access or use) the Platform
Any content obtained from the Platform
Supplement recommendations generated by the Scanning App
Unauthorized access to or alteration of your data
Any other matter relating to the Platform or Products

IN NO EVENT SHALL HERB DOCK'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO HERB DOCK IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Herb Dock and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

Your access to or use of the Platform
Your violation of these Terms
Your violation of any applicable law or the rights of any third party, including any injury you may cause to any third party
Content you submit to the Platform

14. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy with respect to privacy matters, the Privacy Policy shall govern.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms that is not subject to arbitration under Section 16 shall be brought exclusively in the state or federal courts located in Arkansas, and you consent to personal jurisdiction in those courts.

For users located in the European Union or United Kingdom, nothing in these Terms affects your statutory rights under applicable consumer protection laws, and mandatory consumer protections in your jurisdiction will apply regardless of the governing law clause above.

16. Dispute Resolution and Arbitration

Please Read Carefully: This section requires you to resolve most disputes with Herb Dock through binding individual arbitration rather than in court, and waives your right to participate in class action lawsuits. You have the right to opt out of arbitration as described below.

16.1 Informal Resolution First

Before initiating any formal dispute, you agree to contact us at legal@herbdock.com and give us 30 days to attempt to resolve the issue informally. Most concerns can be resolved quickly this way.

16.2 Binding Arbitration, Waiver of Right to Trial by Jury

If informal resolution fails, you and Herb Dock agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or our Products (excluding claims for injunctive relief and intellectual property disputes) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

BY USING THE PLATFORM AND AGREEING TO THESE TERMS OF SERVICE, YOU AND HERB DOCK AGREE THAT BOTH PARTIES WAIVE THEIR RIGHT TO A TRIAL BY JURY OR OTHER TRIAL IN ANY COURT OF LAW OR EQUITY TO THE MAXIMUM EXTENT ALLOWED BY LAW FOR ANY DISPUTE, LEGAL CLAIM, OR OTHER LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM (INCLUDING THE SCANNING APP) OR OTHER SERVICES PROVIDED BY HERB DOCK, ANY TRANSACTION WITH HERB DOCK (INCLUDING YOUR PURCHASE AND/OR USE OF PRODUCTS FROM HERB DOCK), AND ANY OTHER MATTERS BETWEEN YOU AND HERB DOCK.

The arbitration shall be conducted in Arkansas or, at your election, by telephone or video conference. The AAA's rules are available at www.adr.org. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

16.3 Class Action Waiver

YOU AND HERB DOCK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. THIS INCLUDES ANY FORM OF COLLECTIVE ARBITRATION ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

16.4 Opt-Out Right

You have the right to opt out of the arbitration agreement by sending written notice to legal@herbdock.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

16.5 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Nothing in this section prevents you from reporting issues to regulatory authorities or exercising statutory rights that cannot be waived by contract.

16.6 EU/UK Users

If you are located in the European Union or United Kingdom, the mandatory arbitration and class action waiver provisions in Sections 16.2 and 16.3 do not apply to you. You retain the right to bring claims before the courts of your country of residence and before applicable consumer protection authorities.

17. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason including violation of these Terms. You may terminate your account at any time by contacting us at support@herbdock.com.

Upon termination, your right to use the Platform will immediately cease. Sections that by their nature should survive termination will survive, including Sections 7 (Intellectual Property), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), and 16 (Dispute Resolution).

18. Changes to the Platform

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice or liability. This includes the Scanning App, product availability, pricing, and any features or functionality. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

19. Affiliate Program

Herb Dock operates an affiliate referral program through GoAffPro. Participation in the affiliate program is subject to a separate Affiliate Agreement that will be provided to affiliate partners upon enrollment. The general provisions of these Terms also apply to affiliates with respect to their use of the Platform. In the event of any conflict between these Terms and the Affiliate Agreement, the Affiliate Agreement shall govern with respect to affiliate-specific matters.

20. Miscellaneous

20.1 Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, as may be amended from time to time, constitute the entire agreement between you and Herb Dock with respect to your use of the Platform and supersede all prior agreements and understandings.

20.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

20.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Herb Dock.

20.4 Assignment

You may not assign or transfer these Terms or any of your rights or obligations without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

20.5 Force Majeure

Herb Dock shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemic, war, terrorism, labor disputes, internet outages, or government actions.
